1. Definitions

• Website / Platform — the website accessible at https://polskitest.pl, providing access to tests and services.
• User — an individual user of the website (whether registered or not).
• Account — an individual account created by the User upon registration.

2. Services

The Platform provides:

• Access to trial and paid Polish-language proficiency tests
• Storage of test-taking statistics
• Feedback on results
• Error explanations (if included in a specific service)

The subject of the paid services provided by the Service is making available to the User proprietary technology for the automatic checking, analysis and assessment of the User's answers, including with the use of artificial intelligence systems, as well as account features, statistics and feedback. The fee paid by the User constitutes remuneration solely for those services. The Service does not commercially make available, license or transfer textual, graphic or audiovisual materials of third parties.

Materials originating from official examination papers of the Państwowa Komisja do spraw Poświadczania Znajomości Języka Polskiego jako Obcego are used solely as a basis for conducting an educational exercise and verifying the User's answers. The Service is not a distributor of those materials and does not act in the name of or on behalf of the Państwowa Komisja. Those materials come from publicly available sources published by the Państwowa Komisja and serve solely informational, educational and analytical purposes.

Some features are available only to registered users.

3. Registration and Account

• Users may create an account via email or third-party providers (Google)
• Users must provide truthful information
• Users are responsible for the security of their access credentials
• Accounts are personal and non-transferable

4. Payment Terms

• Access to paid tests is granted after successful online payment via bank cards, BLIK, Google Pay, Apple Pay, etc.
• Prices are listed in Polish zloty (PLN) and are not subject to VAT under applicable tax law.
• The remuneration set out in the price list covers solely the service of access to the technology for checking and analysing answers and related Service features. That remuneration does not constitute a fee for the use of third-party works or for rights to those works.

5. Refunds

In accordance with the Polish Consumer Rights Act (📜 Ustawa z dnia 30 maja 2014 r. o prawach konsumenta):

• Users may cancel the service within 14 days if access to content has not yet been granted
• If the User has started using the service (e.g. opened a paid test), the right to refund is void
• Refunds are available only upon individual request via email: Loading...

6. Complaints

The User may file a complaint concerning non-conformity of the digital service with the contract (e.g. paid access not granted or a material platform defect). A complaint is separate from the right of withdrawal described in section 5.

A complaint may be submitted:

The complaint should include:

• full name and account email address
• a description of the problem and the date it occurred
• order or transaction details, if available
• the expected resolution

Complaints are considered within 14 days of receipt. The reply will be sent to the email address provided in the complaint.

The User may also use out-of-court dispute resolution, including assistance from a consumer ombudsman.

7. User Obligations

Users agree to:

• Not violate applicable law
• Not use the website for spam or malware distribution
• Not copy or distribute site materials without permission
• Respect the intellectual property of the platform owners

8. Limitation of Liability

• We do not guarantee continuous or uninterrupted availability of the website
• We are not responsible for consequences caused by test errors or temporary site unavailability
• All materials are provided solely for educational purposes

Automated assessment of answers, including assessment performed with the use of artificial intelligence, is solely auxiliary, indicative and advisory in nature. It does not constitute an official examination result, an opinion of the Państwowa Komisja do spraw Poświadczania Znajomości Języka Polskiego jako Obcego, or any certification of language proficiency.

The Administrator does not guarantee that the result obtained in the Service will correspond to the result of the state examination in Polish as a foreign language, or that the User will obtain a particular level, grade or certificate. The Administrator is not liable for differences between the result presented in the Service and the result of the state examination, for educational, examination or professional decisions made by the User or third parties, including parents or guardians, on the basis of the assessment presented in the Service, or for the consequences of those decisions.

9. Intellectual Property

Economic copyright in excerpts from literary, journalistic and other third-party works used in examination materials belongs to their original authors, heirs or publishers. The Administrator does not claim rights to those works, does not acquire them and does not grant licences to them.

Such excerpts form part of the official examination materials of the Państwowa Komisja do spraw Poświadczania Znajomości Języka Polskiego jako Obcego and have been cited in the Service solely as a basis for an educational exercise and analysis of the User's answers, with an indication of that source. The Administrator's intellectual property covers solely elements created by the Administrator, including the answer-checking technology, original task texts, software, the layout of the Service and original explanations, insofar as they do not constitute a third-party work.

• Copying, distribution, or commercial use of materials without permission is prohibited

10. Copyright Infringement Notice Procedure

The Service Provider respects the intellectual property rights of third parties. A rightsholder of economic copyright, including an author, heir or publisher, who considers that the presentation of a particular excerpt in the Service infringes their rights may report that infringement without first commencing court proceedings.

A notice is submitted by email to: Loading.... The notice should include:

• the full name or business name of the complainant and an email address for correspondence
• identification of the work together with the exact URL of the Service page to which the notice relates
• a description of the rights held by the complainant in that work and evidence or a statement confirming ownership of those rights, made with awareness of liability for the accuracy of the information
• a statement that the complainant is acting in good faith and that the information contained in the notice is accurate and complete

The Service Provider acknowledges receipt of the notice at the email address provided. If the notice is incomplete, the Service Provider requests that it be supplemented. Where a complete notice is received, the Service Provider, without awaiting a court judgment, within 48 hours of receipt temporarily disables access to the disputed material. After examining the notice, the Service Provider permanently removes the material or maintains the block if the infringement is confirmed, or restores the material if the notice proves unfounded or the complainant fails to demonstrate the rights claimed. The Service Provider informs the complainant of the outcome.

Submission of a notice does not constitute an admission of infringement by the Service Provider. This procedure does not limit rights arising under applicable law and does not exclude recourse to the courts.

11. Amendments to the Terms

• We reserve the right to modify these Terms at any time
• Changes will be communicated on the site or by email to registered users
• Continued use of the website after changes constitutes acceptance of the new Terms

12. Governing Law and Jurisdiction

• Any disputes arising from the use of the site are governed by Polish law
• Parties agree to attempt to resolve disputes amicably
• If pre-litigation resolution fails, disputes will be heard in court located at the Administrator's place of business
